1. Acceptance of Terms

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part, do not use our services. Terms may be updated without notice, though we rarely change our runes.

2. Services

Ice Wizard Solutions provides consulting, software development, performance optimization, and security engineering services. Engagements are scoped in writing prior to commencement. Deliverables are defined clearly — magic only works when the rules are agreed upon.

3. Client Responsibilities

You must provide timely feedback, clear specifications, and pay on agreed terms. If not, the owls stop flying. That would be unfortunate for everyone.

4. Intellectual Property

Unless explicitly agreed otherwise, Ice Wizard Solutions retains ownership of any pre-existing tools, utilities, or libraries used. Final deliverables tailored to a client may be transferred upon full and final payment.

5. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages. Total liability is limited to fees paid for the relevant service engagement.

6. Termination

Either party may terminate a project with written notice. Fees for work performed up to the point of termination remain due.

7. Refund Policy

Due to the custom and time-intensive nature of our services, all payments are considered final unless explicitly stated otherwise in a written agreement. Refunds are granted only in cases of demonstrable non-delivery or failure to meet agreed specifications, and only at our sole discretion.

8. Governing Law

These Terms are governed by the laws of New Zealand. Disputes shall be handled by the appropriate court. We prefer resolution by dialogue, not fireball.
